These Terms & Conditions apply to any orders placed on the The Peacock WEBSITE. The Peacock is a limited company with registered address at B-403 lake Castle, Hiranandani Gardens, Powai, Mumbai – 400076. In all events, use by the customer of the services offered on this WEBSITE represents acceptance of all the terms and conditions mentioned herewith, based on the version published by The Peacock at the time the order is placed. Therefore, it is advisable that the customer reads these Terms and Conditions before proceeding with placing an order.

1. Purpose of the contract

These online purchasing conditions apply to any order placed on this WEBSITE by customers whose delivery address is located in any of the following countries:


The prices of each of the products and are those listed on this WEBSITE on the date of the order. Prices are listed for each item including taxes and charges. Special discounts maybe offered to customers based on contracts outside the scope of this WEBSITE.

Shipping costs and any other service shall also be specified and broken down for the customer in a contract that exists outside the scope of this WEBSITE.

The shopping service offered by this WEBSITE only pertain to individuals who are over the age of 18 years and residing in one of the aforementioned countries. Further, this WEBSITE may only be used by individuals who have been granted access by The Peacock and explicitly communicated of the same via email.

The Peacock reserves the right to delete the account of a customer if fraudulent, speculative or malicious acts are committed while using this service. No prior warning maybe given before restricting access.

If considered appropriate, The Peacock will modify and update items and prices according to the company’s trading standards. As such, all prices mentioned on this WEBSITE are for reference purposes only. Discounts offered and final pricing are beyond the scope of this WEBSITE and should be confirmed with The Peacock before confirming the order.

2. Contract Procedure

The purpose of this WEBSITE is to act as a catalog for customers and allow the customer to place a provisional order, that will be verified before being confirmed. As such, the customer will have access to all the information required to place an order, on this WEBSITE. The basic user flow is as follows:

  1. Product selection and adding to cart
  2. Verifying products added to the cart and proceeding to checkout
  3. Provide customer details on the checkout page
  4. Place an order online
  5. Pay Online Via Payment Options
  6. Billing
  7. Order confirmation
  8. Delivery

Lastly, during the online ordering process, you will be required to enter the details (e.g. your delivery address) necessary to process and control your purchase (specifically, the delivery of the product and the payment thereof). The billing details used will be those listed in the user’s registration information. The Peacock is not responsible for errors committed by the customer in entering the details provided for the purchase. Thus, the customer must pay special attention when filling out the forms, notwithstanding the possibility of correcting said details after making the purchase, where possible, via email at hello@peacockjewellery.com

If the customer enters erroneous details during the purchasing process and the correction thereof results in expenses, The Peacock reserves the right to charge the user said expenses or cancel the purchase.

3. Obligations of the stakeholders

3.1. Payment – Following conditions apply regardless

Customers of any product undertake to use the WEBSITE diligently and in good faith, to pay the established price and to accept responsibility for the authenticity of the data provided during the transaction.

The prices of each of the products are those listed on the WEBSITE on the date of the order and include taxes and charges. Special discounts maybe extended to customers from time to time.

All payments must be made on the basis of the amount generated on the order confirmation screen, and amount shown on that screen is final. The invoice will be shared post payment.

3.2. Delivery

Except where, the opposite is expressly established via communication outside the scope of this WEBSITE, the delivery procedure of The Peacock is as follows:

The shipment shall be sent to the address indicated by the customer during the purchasing process, as completed in step 3 (Details Form);

The shipment shall be sent via a courier service, provided by a third party (FEDEX, SEUR, SEQUEL, BVC, OTHERS – COURIER COMPANY) who undertakes to deliver the product paid by the customer to the delivery address within 72 hours.

  • Shipping and stocking periods for each product are visible on the individual product pages.

Neither The Peacock nor THE COURIER COMPANY shall accept responsibility for any customs procedures that may delay the shipment.

If there are any problems in processing the order or shipment, The Peacock will contact the customer to inform him/her of the situation. The customer may also always contact The Peacock to check the status of an order or a shipment by emailing hello@peacockexports.com.

Except where, the opposite is expressly established, the shipping costs of the product or service acquired through the Service shall be borne entirely by The Peacock.

4. Cancelation, Returns, repairs and refunds

All sales are considered to be final within 24 hours of receiving the order. Beyond that, the customer will not be able to cancel the order. If the order is canceled within 24 hours, a refund is initiated and the amount is credited back to the customer’s account within 7-10 working days.

We offer repairs for manufacturing defects/ breakages, if any, during the first 14 days of ownership. We do not offer returns or exchanges for any other reasons. To be eligible for a repair due to defect in the first 14 days, your item must be unused and in the same condition that you received it. It must also be in the original packaging and must include any certificates pertaining to the original stone. 5. Existence of guarantees

The Peacock offers its customers products and services of the highest quality.

Our pieces are made in first-class 18 karat gold.

Each piece we sell is set with 100% natural diamonds, unless otherwise requested by the client. Each piece is sourced responsibly, and there is no involvement of child labour. Non of the pieces contributes to funding of suspicious activity, and conforms to the rules set by the United Nations. Each of the pieces has been certified based on guarantees provided by suppliers.

Given the special characteristics of the products and services marketed by The Peacock on the WEBSITE, there are slight differences between each product or service due, fundamentally, to the uniqueness and exclusivity of each and every one of the materials and stones used to make them, work that is largely done by hand. Thus, no two products or services are exactly alike and, in any case, it is inevitable that the product delivered to the customer differs slightly from the model shown in the photographs of the on the WEBSITE (even if it were the same). In no case do these differences imply that the products or services are of a lower quality of materials than those described expressly on the WEBSITE. Likewise, the customer is informed and aware that the size of the photographs on the WEBSITE does not correspond to the actual size of the products.

Thus, the customer is expressly informed and aware of these circumstances and differences and they may not be the cause for a termination of the Contract.

7. Intellectual and industrial property

All contents (including the graphic design, source code, logos, texts, graphics, illustrations, photographs, trade names, trademarks or distinguishing signs and any other elements appearing on the WEBSITE), unless specifically stated otherwise, are owned exclusively by The Peacock.

No intellectual or industrial property rights with regards to the WEBSITE or any of its integral elements shall be assigned to the customer, and the reproduction, transformation, distribution, public communication, provision, extraction, reuse, reshipment or use of any nature, by any means or procedure, of any of them is expressly prohibited, except in the cases permitted by law or when authorised by the holder of the corresponding rights.

The customer may view and obtain a private temporary copy of the contents for exclusive personal, private and non-collective use on his/her computer systems (software and hardware), provided that such use is not carried out with the purpose of developing collective, commercial or professional activities. The customer must abstain from obtaining or attempting to obtain the contents by means or procedures other than those which have been made available to him/her or indicated for that purpose or those used frequently on the Internet (provided that they do not pose a risk of damage or a risk of rendering the WEBSITE useless). The customer must respect the intellectual and industrial property rights of the WEBSITE at all times, which are held by The Peacock.

In any event, The Peacock reserves the right to modify, at any time and without prior notice, the presentation and configuration of the WEBSITE, as well as the General Conditions or the corresponding Specific Conditions.

8. Non Disclosure

By using this website, the customer by default agrees to a non-disclosure agreement. This Nondisclosure Agreement (the “Agreement”) is entered into between The Peacock and the customer, for the purpose of preventing the unauthorised disclosure of Confidential Information as defined below. The parties agree to enter into a confidential relationship with respect to the disclosure of certain proprietary and confidential information

8.1 Definition of Confidential Information – For purposes of this Agreement, “Confidential Information” shall include all information or material that has or could have commercial value or other utility in the business in which The Peacock is engaged. This contents of this website are confidential in nature and by using the website, the client agrees to honour the confidentiality clause as mentioned here. The contents of this website include all the images, text contained on the website. It also includes the jewellery designs, pricing of products, raw material specifications and product options offered. The structure and flow of the website is also confidential in nature and may not be shared with any third parties. Further, user information like the designated username and password is confidential in nature, and should not be shared with third parties/ competitors/ other suppliers.

8.2 Exclusions from Confidential Information – Customer’s obligations under this Agreement do not extend to information that is: (a) publicly known at the time of disclosure or subsequently becomes publicly known through no fault of the Customer; (b) discovered or created by the Customer before disclosure by The Peacock; (c) learned by the Customer through legitimate means other than from the The Peacock or The Peacock’s representatives; or (d) is disclosed by Customer with The Peacock’s prior written approval.

8.3 Obligations of Customer – Customer shall not, without the prior written approval of The Peacock, use for Customer’s own benefit, publish, copy, or otherwise disclose to others, or permit the use by others for their benefit or to the detriment of The Peacock, any Confidential Information. Customer shall return to The Peacock any and all records, notes, and other written, printed, or tangible materials in its possession pertaining to Confidential Information immediately if The Peacock requests it in writing.

8.4 Time Periods – The nondisclosure provisions of this Agreement shall survive the termination of this Agreement and Customer’s duty to hold Confidential Information in confidence shall remain in effect until the Confidential Information no longer qualifies as a trade secret or until The Peacock sends Customer written notice releasing Customer from this Agreement, whichever occurs first.

8.5 Relationships – Nothing contained in this Agreement shall be deemed to constitute either party a partner, joint venturer or employee of the other party for any purpose.

8.6 Integration – This Agreement expresses the complete understanding of the parties with respect to the subject matter and supersedes all prior proposals, agreements, representations, and understandings. This Agreement may be amended by The Peacock as and when required so as to make it more stringent.

8.8 Waiver – The failure to exercise any right provided in this Agreement shall not be a waiver of prior or subsequent rights.

8.9 Notice of Immunity – Customer is provided notice that an individual shall not be held criminally or civilly liable under any federal or state trade secret law for the disclosure of a trade secret that is made (i) in confidence to a federal, state, or local government official, either directly or indirectly, or to an attorney; and (ii) solely for the purpose of reporting or investigating a suspected violation of law; or is made in a complaint or other document filed in a lawsuit or other proceeding.

9. Availability of the online purchasing service

The Service will be permanently available 24 hours/day. The Peacock informs the customer that anomalies or interruptions in the availability or functioning of the Service due to reasons not attributable to The Peacock (technical problems with Internet providers, telecommunications, problems with the customer’s terminal, etc.) may produce delays and the purchasing of products or services may take longer.

10. Shipping

For parcels within India, we relay on either BVC Logistics, or Sequel Logistics. Both of them are specialised couriers, and have expertise in valuable cargo. Your cargo will be shipped with insurance, irrespective of the carrier used.

Shipping is free for order value upwards of ₹20,000/-. Below that threshold, you will be charged a ₹2500 shipping fee for products.

Our pieces are of two types – there is a Ready to Wear collection that typically takes 2-3 weeks to ship. Once shipped, our shipping partners typically take 2-3 days to deliver the parcel within India. For our Made to Order, bespoke pieces, it usually takes 6-8 weeks to dispatch the pieces. Once dispatched, it typically takes 2-3 days for our partners to deliver the pieces within India.

10.1 International Shipping

Important Notes for International Clients: All international clients are responsible for any and all shipping costs and customs charges. Many countries require VAT/import fees at customs before delivery can be completed. The buyer is solely responsible for payment of these customs fees.

For returns and repairs, we will specify that the purpose of the shipment is “Return and Repair,” and we will also include an Alteration Declaration form. (Note that even if your country claims to not charge fees for this service, the possibility remains that they will charge anyway. The buyer is responsible even for those fees because they are completely out of our control.)

Orders will be shipped via FedEx International Priority and typically take 3-7 days to deliver. Customs and broker fees will be the client’s responsibility upon delivery. Your customs office can estimate these charges for you.

Please make sure your shipping address is correct. Again, if your package is returned to us for any reason (whether you weren’t available at the time of delivery, or because the customs fee wasn’t paid, or any other reason), we will not be able to accommodate any refunds, and you may be charged an additional fee to re-attempt delivery.
